Medical Card holders can not be discriminated against for legally using lawful medical marijuana off-premises and outside work hours; or for testing positive for medical marijuana.

Your employer can prohibit the possession, use, or being under the influence of cannabis while on the employer’s premises or during work hours.

On a state-level Cannabis laws are changing rapidly and often. So, knowing your ‘cannabis’  rights as a Medical-Card holder is more important than ever.

With Medical Cannabis Card your employer cannot discriminate against or penalize you for any of following:

  1.  having a valid patient ID card; or
  2. legally using lawful medical marijuana off-premises and outside work hours; or
  3. testing positive for medical marijuana.

Your employer can still drug test you. However, if you have valid Missouri patient ID card, they cannot take action against you for testing positive for medical marijuana.

As the law matures we expect many of the holes in the amendments to be fixed. For example it must be  clarified under this new Constitutional Amendment, exactly what evidence is required to establish someone is under the influence of marijuana.
